Rental Agreement
Tiki Red Campervan Hire Terms & Conditions/ Campervan Rental Agreement

The customer always comes first when you hire a Tiki Red Campervan Hire VW Campervan. To ensure you know exactly what to expect during your booking and hire please read our Terms and Conditions below.

Passengers
Tiki Red Campervan Hire authorises the use of this vehicle up to 4 passengers including the Driver. Each person to use the safety restraints provided at all times whilst vehicle is in motion.

Drivers
Drivers must be between 25 and 75 years old. A refundable security deposit of £600 (£1000 for under 25 or over 70) to cover Campervan Insurance Excess applies to all our VW Campervan hires with UK Driver’s license and with Non-UK licenses held within the EU, Canada, USA, Australia and New Zealand.
Main Drivers must provide Photo ID license prior to hire commencement plus 2 items of residential proof of the main Driver (2 Utility bills from separate companies less than 3 months old is acceptable.) If the Driver does not have a Photo License ID, the paper license and a passport is required.

Additional Drivers must provide both paper license and Photo ID license prior to hire. If the Driver does not have a Photo License ID, the paper license and a passport is required.
Details of any additional drivers are required in advance of rental period.
Drivers are personally liable for all legal penalties (e.g.: parking tickets) which are incurred during the period of hire.
Maximum of 2 drivers per rental
All drivers must be present at Booking Hire Start Day

150 miles per day*
UK standard vehicle insurance**
UK standard equipment & breakdown

* 150 miles per day unless discussed prior and agreement signed. all miles over 150 per day charged at £1 per mile. Our vehicle trackers log the mileage.
** Insurance loading. In some cases, Tiki Red Campervan Hire will incur additional charges if the driver to be insured is under 25, has a traffic conviction, is using a non-UK driving license or is in an occupation which is deemed high risk. These charges will be passed onto the customers.

Payment of your Campervan Rental
Availability is on a request and confirm basis at the time of reservation. A reservation is only binding after it has been confirmed by Tiki Red Campervan Hire and a non-refundable deposit of 25% of booking has been received. Our terms and conditions including cancellation policy will apply from this point onwards. Once the reservation is confirmed, a confirmation email will be sent out to the customer. Settlement of the remaining balance will be due 5 weeks prior to Booking Rental Start date. A refundable security deposit is included in the booking total  to cover Insurance Excess and any damages or road traffic fines incurred and can be paid through PayPal, with a credit or debit card or by bank transfer. Payment for the security deposit will be refunded 14 days after end of hire less any incurred costs. I irrevocably authorise Tiki Red Campervan Hire to deduct from the security deposit any amounts due by me to Tiki Red Campervan Hire arising out of this agreement. The security deposit will be refunded by PayPal or bank transfer 14 days after the return of the Campervan provided the vehicle being returned to the correct location, undamaged, with a clean interior with a full fuel tank. We reserve the right to retain a £100.00 soiling fee if the Campervan is not returned with the interior in a clean condition

Tiki Red campervans are to be driven in the UK only, any trips to Europe must be discussed before hire and relevant insurance and breakdown cover costs will need to be added.


Deposit
The 25% deposit is non refundable to cover us for cancellations.

You will receive 100% of security deposit payments with cancellations

Tiki Red Campervan Hire cannot postpone or transfer money from one hire to another.

Security deposit

The Hirer will pay the sum of £600 (£1000 for under 25 or over 70s), 5 weeks before the date of hire, as a Security Deposit which will be refunded on return of the vehicle, after damage checks have been completed or retained in full or part until the vehicle is repaired to a condition that is satisfactory to the owners, without any time limits being imposed. The deposit is fully refundable within 14 days, provided that the vehicle is returned on time, undamaged, with a clean interior, with a full tank of fuel and no excess charges are due.

 We reserve the right to retain monies from your damage deposits as follows:

 (a) Soiling fee £100 if the vehicle is not returned with the interior in a clean condition

 (b) Toilet emptying fee £50 if the toilet is not returned empty & clean. Toilet cassettes will be inspected upon the vehicles return. If included in hire (additional fees apply), instructions on how to empty the toilet cassette will be given in handover procedure.

 (c) Fuel surcharge at current cost, if the tank is not returned full - amount depends on level of tank. Plus a £30 service charge.

If there is damage or breakdown caused by your own actions; you will be liable for the cost of repair/replacement. This could include pushing the engine too hard, or using the incorrect fuel (this list is not comprehensive). You must check the oil, water daily refilling as necessary before driving and other gauges (temperature and any warning lights whilst driving)

The hirer will be liable for any costs associated with the incorrect use of fuel. E.g. filling the petrol tank with diesel or the diesel with petrol.

The maximum height of the vehicle is 8’ 5” or 2.57m. It is the responsibility of the hirer to ensure damage to the roof by passing under bridges, car park barriers, low tree branches or hitting the roof by any other means does not occur. The hirer will be liable for any damage caused.

There is no smoking or vaping in the Vehicle. Any evidence of smoking or vaping in the Vehicle shall incur a cleaning fee of £250

You are liable for the cost of any damage or punctures. In the event that a tyre is returned damaged at the end of your hire, it will be at our discretion whether to repair or replace it.

If the vehicle is returned damaged, we reserve the right to withhold the entire security deposit awaiting costs for the damage to be repaired. If a tyre is returned damaged £130 will be withheld. Once a new tyre has been obtained and fitted any excess balance will be returned to the hirer within 14 days of the end of the hire term.

If the vehicle is returned past the date and specified time, hirers render themselves liable to overtime charges of £25.00 an hour. (Please remember this may affect someone else’s holiday too.)

Rental and other charges
I will pay Tiki Red Campervan Hire:

All rental charges
The security deposits.
The nominated cancellation fee in the event of cancellation of this agreement prior to acceptance of delivery of the vehicle. 
The cost of any damage to the vehicle or the property of any third party, subject to the insurance*
All government fees and duties etc. 
All parking fines, other fines or penalties, and/or accidents including third party property damage not reported on return of the vehicle; and associated administration costs incurred in relation to the vehicle during the rental period
Any other fees or charges payable by me pursuant to this agreement. *
The daily rental rate for the period the vehicle is off fleet for accident repairs*
The cost to recover a vehicle which has become bogged.*
*This cost is up to the insurance excess amount provided all Terms and Conditions are adhered to. If the insurance deems the insurance to be invalid due to inappropriate use of the vehicle and there has been a breach by the hirer of the terms of this agreement, then the hirer will be liable for all costs.

Payment

You agree that you will be responsible for full payment of any sums due to us should the Security Deposit you have paid not be sufficient to cover the cost of any damage or other costs as set out in these Terms & Conditions. You agree to indemnify us for all costs, damages expenses claims and losses which we incur suffer or become responsible for as a result of any act or omission by you which results in our being unable to receive full payment for such costs, damages, expenses claims and losses under the insurance cover referred to in these terms and conditions.

Campervan Collection and return
Collection: Please allow up to 1 hour for the hand-over of the Campervan to complete documentation and demonstrate our vehicle to you.

Return: Please allow up to half an hour on the return of your vehicle to hand over and check the condition of the vehicle. The vehicle must be returned with a full tank of fuel and returned in the same condition that it was rented to you. The vehicle must be returned on the date stated on the rental agreement and before the stated check out time. The hirer must advise Tiki Red Campervan Hire if they are delayed for any reason and additional charges may be charged.

I acknowledge that having received the vehicle in a clean condition and in sound working order in accordance with the departure checklist and with a full fuel tank:
I will return the vehicle in a clean condition with a full fuel tank, on the return date and time set out under the heading ‘check in’ in the rental agreement.
I acknowledge that Tiki Red Campervan Hire will not refund to me any monies, nor have any obligation to provide a replacement vehicle, if the vehicle is returned or I cease to have the use of the vehicle prior to the return date for any reason e.g. accident, weather or theft.
If a breakdown occurs whilst on rental and it has to be returned to workshop, we will return any remaining days hire fee and any costs to cover parts for vehicle. We do not cover any campsite costs or other costs.
If the vehicle is returned with out a full tank of full the cost of refuelling will be deducted from the security deposit.
If the vehicle is returned uncleaned (inside i.e. cooker/floor/seats etc.) there will be a £50 cleaning charge took off the security deposit.

Title to vehicle
I acknowledge that Tiki Red Campervan Hire retains title to the vehicle and that I possess the goods as a mere bailee only. I do not have any right to pledge Tiki Red Campervan Hire credit in connection with the vehicle and agree not to do so. I shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the vehicle.

Use of the vehicle
I agree that during the rental period, I will not and will not allow the vehicle to be:
Driven otherwise than in a cautious, prudent and normal manner;
Used in a manner which could cause damage;
Driven in a prohibited area or in an area other than the areas indicated by me to Tiki Red Campervan Hire;
Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;
Left with the ignition key in the vehicle while it is unoccupied
Left unoccupied without the cd faceplate removed, steering wheel security lock applied;
Driven by persons:
Under the age of 25 years; or who is not authorised by law to drive the vehicle. Particulars of a proposed licensed driver of the vehicle are set out under the heading ‘driver details’ in the motor rental agreement.
Damaged by:
Submersion in water
Contact with saltwater
Used for any illegal purpose for any race, rally or contest
Used to tow any vehicle or trailer.
Used to carry passengers or property for hire or reward
Used to carry more persons than is permitted by any relevant authority or detailed in the vehicle manual or on the vehicle or specified in this agreement
Used to carry volatile liquids, gases, explosives or other corrosive or inflammable material
Otherwise used in breach of my obligations under this agreement.

Tiki Red Campervan Hire's obligations

Tiki Red Campervan Hire shall supply the Vehicle in a safe and roadworthy condition, up to the current MOT Certificate standards. If the Vehicle is not available for reasons outside Tiki Red Campervan Hire’s control, Tiki Red Campervan Hire’s liability shall be limited to a refund of the hire charge in full. In the case of mechanical failure (unless caused by the Hirer), Tiki Red Campervan Hire’s liability shall be limited to the hire charge for the remainder of the term of hire.

Hirer's obligations

The Hirer shall ensure that:

 (a) All reasonable care is taken when driving and parking the Vehicle.

 (b) The engine coolant and oil in the Vehicle are maintained at the proper level and checked every 3 days.

 (c) The tyres are maintained at their proper pressure.

 (d) The Vehicle is locked and secure at all times when it is not in use.

 (e) The Vehicle keys are kept secure. The cost of replacement keys and related services for example courier is at the Hirer’s expense.

 (f) No part of the engine, transmission, braking or suspension systems are interfered with.

 (g) The fuel tanks are filled with the correct fuel and the freshwater tanks are not contaminated. The cost of replacing tanks is at the Hirer’s expense.

 (i) Should a warning light be illuminated, or the Hirer believes the Vehicle requires mechanical attention; they should stop driving and advise Tiki Red Campervan Hire immediately.

 (j) The fuel/temperature gauges shall be carefully monitored.

 (k) There is no smoking or vaping in the Vehicle. Any evidence of smoking or vaping in the Vehicle shall incur a cleaning fee of £250.

 (l) The maximum height of the vehicle is 8’ 5” or 2.57m. It is the responsibility of the hirer to ensure damage to the roof by passing under bridges, car park barriers, low tree branches or hitting the roof by any other means does not occur.

The absolute maximum speed that this vehicle should be driven is 70mph, and it will be more comfortable at 60mph.

Fit to drive and safety

 Many road traffic accidents are caused by tiredness. Avoid driving when tired and stop in a safe place for regular breaks before fatigue sets in. It is recommended that you do not drive for more than two hours without taking a break of at least 20 minutes duration.

Driving whilst under the influence of drugs or alcohol is strictly prohibited. Before driving, seek medical advice if in doubt as to the effect of any prescribed medication that you are taking.

In adverse weather conditions, such as fog or icy roads, it is recommended that you delay your journey.

Safety belts must be worn in both front and rear seats and it is the driver’s responsibility to ensure they are used at all times. Please be aware that the rear seatbelts are lap belts. It is your responsibility to ensure any child seat used is fitted in a correct and safe way.

Personal possessions

It is the hirer’s responsibility to provide their own insurance to cover personal items and

 belongings and personal injury in the event of an accident.

Alterations to the vehicle
I shall not make any alterations or additions to the vehicle without the prior written consent of Tiki Red Campervan Hire

Maintenance
I shall take all reasonable steps to properly maintain the vehicle, including oil checks, water and batteries.

I acknowledge that Tiki Red Campervan Hire will reimburse me for expenditure up to UK £200.00 reasonably incurred in rectifying any mechanical failure to the drive train and engine of the vehicle (not including the water system, refrigerator, heating, audio equipment) provided that:

I produce relevant receipts
I have received the prior consent of Tiki Red Campervan Hire
The damage is not due to my fault or my breach of this agreement.
Subject to the terms of this agreement, I will pay for the cost of repairing or replacing tyres damaged during the rental period provided that Tiki Red Campervan Hire will reimburse me for expenditure reasonably incurred if:
I produce relevant receipts
The tyre is defective and is returned by me to Tiki Red Campervan Hire for inspection; and
The manufacturer accepts liability under his warranty,
I will be liable for any costs associated with the incorrect use of fuel (fuel being diesel or petrol)

If hire is for 3 days or more I am required to check and top up water/oil every 3 days until hire is finished.

Vehicle height

 This is a high sided vehicle and care must be taken on bridges etc, especially during high winds. Vehicle dimensions are displayed and it is the Hirer’s responsibility to check car park barriers, bridges, low branches etc to ensure damage does not occur.

Responsibility when accident occurs
In the event of any accident, loss or damage arising out of the use of the vehicle
I will notify Tiki Red Campervan Hire within 24hrs of the happening of the event
Obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station;
Complete a European accident report form as supplied
Not make any admission of liability to other parties, settlement offer or other like offer;
Assist Tiki Red Campervan Hire in handling any claim arising from any event, including providing all relevant information and attending court to give evidence.
I acknowledge that the excess or other amount due by me in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period.
I will pay for any costs relating to the delivery of a change over vehicle as a result of an accident regardless of which party is at fault.
Insurance
I agree that the vehicle is insured for damage to the vehicle and the property of a third party
I will have to pay an excess for any damage. The insurance excess is £600 (£1000 for under 25 and over 70) as agreed and paid. Please note that resolution of damage issues is time consuming to resolve and we reserve the right to charge an administration fee in addition to the repair cost.

I will not have any insurance cover and I will be responsible for the total cost of any damage if I breach any of the terms of this agreement

Traffic offences

 The hirer is responsible for any speeding, parking, congestions charge or any other road fines and penalties incurred during the hire period. There will be an administration fee of £25 per incident payable by the hirer.

Own vehicle

 You are welcome to leave your vehicle with us during hire. Vehicle and contents left at your own risk and Tiki Red Campervan Hire accept no liability for any damage, loss or theft. Keys must be left with us.

​Events beyond our control

 Unfortunately, events beyond our control (i.e. events which we could not, even with due care, foresee or avoid) could possibly affect campervan availability. We cannot accept responsibility or pay compensation, costs or expenses where the performance of your contract with us is prevented or affected or you otherwise suffer any loss or damage as a result of events beyond our control. If you are unable to commence your rental as a result of such events, we will provide a full refund of all monies received for your booking, without further liability.

Return of vehicle

The Hirer shall, at or before the expiry of the term of hire, deliver the Vehicle to Tiki Red Campervan Hire as per the signed rental agreement. Failure to return the Vehicle by the time agreed on the rental agreement, in the condition it left, as per terms, will incur a late fee of £25 per hour. If you are running late, you must notify us immediately, as this may affect the next booking.

Pets
We allow dogs (maximum of 2) to travel in our vehicles.

Breakdown and accidents

In the event the vehicle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the Hirer shall notify Tiki Red Campervan Hire of the full circumstances immediately on the contact number provided (please leave a voice or text message if unable to connect). The Hirer shall not arrange or undertake any repairs or salvage without Tiki Red Campervan Hire’s authority except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property. Tiki Red Campervan Hire’s liability extends only to the refund of hire charges for any full days of Vehicle use lost due to a mechanical breakdown. No responsibility for out of pocket expenses, accommodation charges or meals resulting from a breakdown or accident will be accepted..

In the event of an accident, the hirer is to obtain the names, addresses and contact details of third parties involved, as well as any witnesses. Provide photographs of the vehicles involved and the location of the accident. The Hirer undertakes to assist Tiki Red Campervan Hire in handling any claim arising from any event, including providing all relevant information and attending Court to give evidence.

The Vehicle is registered for 24 hour roadside assistance. This service covers any mechanical faults with the Vehicle.

The roadside cover does not cover the following and the associated costs will be the responsibility of the Hirer:

(a) the Vehicle running out of fuel or breakdown is caused by the Vehicle being incorrectly fuelled.

(b) the Vehicle is unable to be accessed due to a lock out or the Vehicle keys being lost.

(c) flat batteries caused by incorrect usage of the batteries and/or incorrect usage of any equipment that requires the batteries in order to operate.

(d) flat or damaged tyre(s).

(e) the Vehicle is unattended at the time roadside Provider arrives at the breakdown location.

(f) the Vehicle is not on public or formed road or is trapped or bogged.

All non-mechanical call-outs to the roadside assistance will incur a call-out charge by the hirer.

Mileage limits

Our campervans are limited to 150 miles per day unless otherwise discussed and an agreement signed by both parties. Any mileage over 150 miles per day will be charged at £1.00 per mile. All our campervans have trackers fitted which allow us to monitor mileage use.

Personal data

When you book your campervan, we will collect personal information such as your name, email address, date of birth, home address, telephone number, bank details and driving licence information. This allows us to book the campervan and insurance for you and to return the security deposit at the end of hire. Any banking details will be disposed of when the security deposit is returned to you following the end of the rental agreement.

If you have agreed, we may use the information that we collect to occasionally notify you about news and special offers that we think you may find valuable.  If at any stage you decide that you would rather not receive such information, please contact us at [email protected]

Release and indemnity of Tiki Red Campervan Hire
Subject to its obligation to deliver the vehicle, I release Tiki Red Campervan Hire, its employees and agents, from any liability to me (regardless of who is at fault) for any loss or damage incurred by me by reason of this agreement, including but not limited to:
Any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for my purpose
Any loss or damage to any property left in or on the vehicle, in any service vehicle or on any Tiki Red Campervan Hire premises or recovered or handled by Tiki Red Campervan Hire.
Subject to any insurance arrangements agreed with Tiki Red Campervan Hire, I hereby indemnify and shall keep indemnified Tiki Red Campervan Hire, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the vehicle.
Instances beyond Tiki Red Campervan Hire control that means they cannot release the vehicle to me due to a prior accident or fault with the vehicle. In this instance, Tiki Red Campervan Hire will endeavour to find a replacement vehicle or give a full refund of the price of hire to the customer.
Road restrictions
All vehicles may only be driven on sealed / bitumen roads.
I acknowledge that Tiki Red Campervan Hire reserves the right at any time, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause

Definitions of terms and conditions
Definitions of terms and conditions ‘I’,’me’ and ‘my’ refers jointly and severally to the person or persons who are the customers; ‘this agreement’ means the rental agreement, the insurance motor rental agreement and these terms and conditions. In the event of any discrepancy between these terms and conditions and any other Tiki Red Campervan Hire literature, the provisions of these terms and conditions apply.

Tiki Red Campervan Hire – ‘Means Tiki Red Campervan Hire owned by James Lindsay, 27 Woofferton road, Portsmouth, Hampshire PO6 4DP
‘customer’ -Means the person or persons nominated as the hirer under the heading ‘hire details’ on the insurance motor rental agreement and any person whose credit card is presented in payment of the customer’s charges.
‘living equipment’ – Includes but is not limited to tv/dvd player, cd player, crockery, cutlery, cooking utensils.
‘Overhead damage’ – All drivers must be aware of the (unusual) height of the motorhome and are responsible for all damage if driven under an obstruction that is too low for it to clear – the obvious examples are low bridges and height restrictions into car parks etc. In this event neither the basic insurance nor collision damage waiver will apply and the hirer will be responsible for the repair of all damages. Overhead damage is deemed as any damage to any part of the vehicle which occurs above 6 feet (1.83 metres) and or any third-party property. The hire rate quoted includes a standard excess of £500 or other amount as agreed by our insurers for licenses outwith UK and EU. In the event of any damage to either the vehicle or third-party property, the hirer will be liable up to the full amount of the security deposit paid. The hirer will also be fully liable for all overhead damage, any damaged deemed as gross negligence and replacement or repair of windows and windscreens or tyre damage.
‘rental period’ – Means the hire period referred to under the heading ‘booking details’ on the rental agreement or any agreed variation thereof and any additional period during which the vehicle is in the customer’s possession or control
‘vehicle’ – Means the vehicle described under the heading ‘vehicle details’ on the rental agreement and includes tyres, tools, accessories, the living equipment and any other special equipment, documents related to the vehicle and any replacement or substitute vehicle which may be provided at the discretion of Tiki Red Campervan Hire.
‘security deposit’ – Means the vehicle security deposit detailed under the heading ‘vehicle security deposit’ in the insurance motor rental agreement. The hire rate quoted includes a standard excess of £500 or other amount as agreed by our insurers for licenses outwith UK and EU.
Terminating the agreement
I acknowledge that Tiki Red Campervan Hire may terminate this agreement and repossess the vehicle at any time, without notification to me, and that I will pay the reasonable costs of repossessing the vehicle, including towing charges if;

I am in breach of any term of this agreement;
I have obtained the vehicle through fraud or misrepresentation;
The vehicle appears to be abandoned
The vehicle is not returned on the agreed return date or Tiki Red Campervan Hire reasonably believes that the vehicle will not be returned on the agreed return date;

Tiki Red Campervan Hire considers on reasonable grounds, that the safety of passengers or the condition of the vehicle is endangered. I understand that in the event of such termination or repossession, I have no right to a refund of any part of the rental charges or the security deposit
 

Changes
Any changes to this agreement must be in writing and must be signed on behalf of Tiki Red Campervan Hire and by me.
My warranties
I warrant that all information supplied by me to Tiki Red Campervan Hire in connection with this agreement is true.

Entire agreement
This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. Tiki Red Campervan Hire reserves the right to add or amend any rental charges without prior notice.
